Jim Holloway joined Baker & McKenzie immediately after graduating from law school in 1991. He practices mainly in the area of intellectual property — with emphasis on disputes and advocacy — and has extensive experience assisting clients with their outbound legal needs.

Practice Focus

Mr. Holloway focuses his practice on intellectual property law, particularly in relation to trademark, patent, copyright and trade secret disputes. He also handles anti-counterfeiting litigation, diversion and grey market matters, domain name disputes, unfair competition claims, marketing and advertising complaints, licensing and distributorship disputes, as well as breach of confidentiality matters. He has advised and represented many leading companies in the intellectual property area, and has acted as lead counsel on matters before the Ontario Superior Court of Justice, the Ontario Court of Appeal, the Federal Court, Trial Division, the Federal Court of Appeal and the Supreme Court of Canada.

Representative Legal Matters

• Represented a California-based computer hardware company in several lawsuits arising from the importation and sale of counterfeit products in and from the Canadian market.
• Represented a company in the oil and gas industry in a Federal Court patent infringement action relating to certain wellbore technology.
• Represented a company in the oil and gas industry in a Federal Court lawsuit arising from the infringement of certain proprietary and copyrighted software.
• Represented a global confectionery company in a trade dress lawsuit arising from a major competitor's adoption of confusingly similar product packaging.
• Represented an Asian electronics company in Canadian class actions involving allegations of price fixing.
• Represented a US electronics company in several lawsuits involving the importation and sale of products that infringed its trademarks, trade dress and industrial designs
• Represented a US-based sporting goods company in lawsuits relating to the importation and sale of counterfeit products in Canada.
