Jasper Helder is a leading EU customs and international trade attorney who counsels multinational companies on EU customs and export controls/sanctions. Practice Focus
Mr. Helder’s practice comprises inbound and outbound trade and customs compliance.
His outbound practice includes EU export controls and economic sanctions (both dual-use and military products and technologies) and the interaction between EU and US rules (e.g. ITAR and EAR). Mr. Helder assists many US clients with their EU compliance and advises a range of multinationals on EU and UN sanctions compliance for countries such as Iran, Libya and Syria and interaction with US rules (such as CISADA and other sanctions regimes).
He also advises on customs classification (including Binding Tariff Information), valuation and transfer pricing (notably royalties/license fees and complex sourcing chains), rules of origin (including Binding Origin Information), the use of customs procedures and customs compliance with a focus on optimizing supply and sourcing chains for European market access. Mr. Helder has extensive experience with the EU common agricultural policy and related import and export issues.
His practice includes advice and litigation. He represents clients before European and national (customs, export and other) administrations and courts as well as before the EU Commission, its advisory committees and the European Court of Justice.
Representative Legal Matters
- Represented clients in voluntary self-disclosures of unlicensed dual-use and military exports as well as exports in breach of EU sanctions in various EU jurisdictions.
- Advised various global companies in different industry sectors on the impact of and compliance with EU sanctions against Libya, Iran, Syria and other countries and interaction with US and UN sanction regimes.
- Negotiated complex valuation rulings with EU customs administrations for, among others, the apparel, electronics and toys industries.
- Represented a global trader in the EU anti-dumping and anti-subsidy procedures on US biodiesel exports and advised on the related EU circumvention investigations in relation to Canadian biodiesel exports.
- Advised on the application of EU rules of origin in relation to trade remedy investigations for IT products.
- Advised various clients on EU and national blocking laws in relation to US Cuba sanctions.
- Obtained specific derogation for rules of origin under EU-OCT free trade arrangement from EU Commission.
