Real Estate Law in Germany

Our German Real Estate Practice Group currently consists of more than 20 lawyers based in Berlin, Dusseldorf, Frankfurt and Munich. Our activities focus specifically on real estate transactions - such as the acquisition or sale of real estate and real estate portfolios. We support our clients on the tax structuring and financing aspects of these transactions and represent our clients in litigation and arbitration proceedings with regard to real estate or construction matters. We work closely with both Global and European Real Estate practice groups.

The members of our practice group include lawyers concentrated in real estate law as well as corporate, financing and tax law professionals. Some members of our group are also public notaries. Together with the Firm's practitioners in related fields such as public construction law, environmental law and public procurement law, we offer a wide range of legal services relating to real estate and industrial facilities. This includes the following areas:

  • Acquisition and sale of real estate and real estate portfolios
  • Renting and leasing of real estate
  • Corporate and tax structuring of real estate portfolios and transactions
  • Advice on the financing of real estate transactions as well as financial leases
  • Advice on construction matters and plant construction contracts
  • All aspects of public law relating to real estate and industrial facilities (development and construction law, environmental and residual pollution law,. public procurement law)
  • Litigation before administrative and civil courts, arbitration and alternative dispute resolution relating to real estate matters

Publications

In its decision dated 15 May 2011, the Federal Tax Court took issue whether a real estate holding entity shall benefit from the “extended base reduction” for Trade Tax purposes. It came to the conclusion that the benefit shall not be granted to the extent the rental income is derived from letting to tax pool members.
Building owners must not delay in investigating the cause of building defects and identifying who is responsible, at the risk of becoming statute barred from bringing their claim to Court.
Seabay Properties Pty Ltd v Galvin Construction Pty Ltd & Anor [2011] VSC 183 has overturned accepted wisdom by clarifying the concept of "excluded amounts". The decision has also affected variations and premature claims — resulting in consequences for contractors, principals and head contractors.
