  • Defending a patent infringement action and conducting simultaneous retaliatory actions across Europe seeking the invalidation of the plaintiff's patents

Our new regular Trade Marks Update reviews recent significant UK, European and worldwide developments in trade mark law and practice. This first edition focusses on the European Commission's proposed amendments to the Community Trade Mark Regulation and Trade Mark Directive, which if adopted will have a number of significant implications for the scope and enforceability of trade mark rights. We also look at recent decisions on the own name defence and infringement proceedings against registered CTM proprietors, pending references to the Court of Justice of the European Union regarding the protection of colour marks and good faith, the latest status on plain packaging for tobacco products in the UK, and the extension of the Madrid Protocol to Colombia, Mexico and India.
