In keeping with Baker & McKenzie’s commitment to global fluency, this updated Handbook summarizes and integrates product recall laws and related regulatory standards from 11 additional jurisdictions not covered in the original edition, including Abu Dhabi, Azerbaijan, Dubai, Egypt, Indonesia, Kazakhstan, Malaysia, the Philippines, Russia, Saudi Arabia, the Ukraine and Vietnam.
In addition to including 11 additional jurisdictions, the 2nd edition of the Global Product Recall Handbook also updates the chapters for many of the countries covered in the original handbook. Several of these countries, representing some of the largest markets in the world, have enacted or promulgated sweeping product safety law changes in the three years since publication of the original edition. For example, the Consumer Product Safety Improvement Act of 2008 was passed in the United States, which is nothing less than a major overhaul of many aspects of US consumer product safety laws. Thailand implemented a similar statutory overhaul, significantly changing the way the nation handles product recalls. In 2009, regulatory changes were enacted in Japan following a highly publicized major product safety occurrence. Japan now has its first Consumer Affairs Agency, effective September 1, 2009, and that agency has already demonstrated that it is hitting the proverbial ground running.
As this Handbook goes to press in October 2009, China’s government is promulgating its first general law on product recalls, following a number of high-profile product recalls. China’s product safety regulatory body, AQSIQ, also continues to emphasize cooperation with other country regulators, such as the US Consumer Product Safety Commission
With the many new product recall laws around the world summarized here, and with the many countries now covered here, this second edition is, to our knowledge, the only book that provides readers with a single, concise, user-friendly source of important information on product recalls in 35 countries representing six different geographic regions of the world. We hope this Handbook provides readers with an increased appreciation for the breadth and depth of business and legal considerations associated with global product recalls.
