Erin McCloskey Maus advises clients on international and domestic products liability and mass tort litigation. She has practiced in many state and federal courts — managing all aspects of discovery and pre-trial litigation, handling court-ordered mediation and arbitration proceedings and trying cases to verdict. Ms. Maus is co-editor of the Firm’s “Global Product Recall Handbook”, and contributing author in “Dispute Resolution in North America” and “Product Liability in North America”. She serves on the Firm’s Pro Bono Board for North America, and has received numerous awards for her representation of pro bono clients.
Practice Focus
Ms. Maus’ practice involves representing international manufacturers and suppliers from varied market sectors in domestic litigation, and assisting local clients in international litigation issues related to service of process, jurisdiction, venue and discovery. She advises clients on all aspects of conducting a global product recall, including implementing a management plan, complying with government investigations, and planning and preparing for eventual civil litigation. She also focuses on contract warranty, distribution, dealer, franchise, sales of goods and Uniform Commercial Code litigation.
Representative Legal Matters
- First-chaired jury trial for a US poultry processor in an alleged wrongful death product liability case arising from an outbreak of foodborne illnesses.
- Defended US and European industrial barrel refurbishers in mass tort state class action lawsuit alleging environmental contamination.
- Settled multiple disputes involving claims brought by US distributors and importers for breach of contract and warranty, tortuous interference, fraud and misrepresentation against US, French, German, English and Spanish manufacturers.
- Settled multimillion dollar dispute between Hong Kong and US corporations involving warranty issues and Articles 2 and 9 of the Uniform Commercial Code.
- Defended a global manufacturer of consumer products in an alleged wrongful death product liability lawsuit pending in state court stemming from a house fire.
- Defended a global manufacturer of furniture products in multiple wrongful death liability actions pending in state court stemming from a large furniture warehouse fire.
