Practice Focus
Mr. Richardson focuses his litigation practice on IP disputes, patents, trade marks and copyrights. He has acted as lead counsel in a broad range of cases covering all IP areas. He regularly assists clients in the pharmaceutical industry, especially with respect to patent litigation as well as commercial, product liability and class actions. In addition, Mr. Richardson is seasoned in general litigation, having represented clients in trials and appeals, as well as administrative hearings on a broad range of complex civil, commercial and quasi-criminal cases.
Representative Legal Matters
- Acted for Merck & Co., Inc. in a patent infringement action against a large Canadian generic drug manufacturer involving the patent for MEVACOR® (Lovastatin), successfully upholding the patent’s validity and infringement after a 16 week trial.
- Defeated a generic manufacturer’s claim for damages under Section 8 of the Patented Medicines (Notice of Compliance) Regulations.
- Represented Schering-Plough in defense of a third party claim for damages allegedly caused by mislabeling of an OTC product. Claim dismissed.
- Counsel to Abbott Laboratories in proceedings under the Patented Medicines (Notice of Compliance) Regulations against a Canadian generic drug manufacturer involving patents covering BIAXIN® (Clarithromycin), obtaining an order prohibiting the generic from market entry until the patent’s expiry.
- Successfully represented Merck & Co., Inc. in patent infringement proceedings involving Merck’s patent covering VASOTEC® (Enalapril).
