Natural Resources & Mining in Australia

Baker & McKenzie's Natural Resources & Mining Group provides effective, focused solutions to the challenges facing companies across the mining and metals, upstream, midstream and downstream oil and gas, petrochemicals, coal and chemical sectors. Our team stands out from its peers in the areas of utility regulation, strategic counsel, transactions and privatisations, and has been instrumental in major assignments for public and private sector clients in both developed and emerging markets.

Our team has advised on every aspect of Australian natural resources and energy projects, including obtaining exploration tenements, offshore acreage and surface land tenure, structuring joint ventures, preparing project agreements and financing documentation. We assist our clients in commercial operations and sales contract negotiations, purchase and sale of interests in projects, and trade sales of asset packages. We also provide general mining, oil, gas, native title, contract, corporate, tax, employment and environmental law advice.

We work closely with Baker & McKenzie's Clean Energy & Renewables Group, who advise our clients on carbon policy and help in developing creative and practical solutions to their carbon emission restrictions.

By drawing on Baker & McKenzie's local and integrated global platform we are capable of handling complicated cross-border resource and mining transactions, for both local and international clients. This global connectivity ensures we consistently offer our clients sophisticated natural resources and mining advice, adopting best-practice standards from across the globe.

The European Commission has opened an in-depth investigation to examine whether the reduction granted under the German Renewable Energy Act (“EEG”) to energy-intensive companies on a surcharge for the financing of renewable energy sources (the “EEG surcharge”) complies with EU state aid rules. Our client alert summarizes the Commission’s decision and its consequences and describes possible courses of action for companies and other stakeholders.
A federal ordinance amending the rules for considering investments in high-voltage distribution grids under the Incentive Regulation Ordinance (Anreizregulierungsverordnung – ARegV) entered into force.
We explain the Dutch government’s measures to implement policies and guidelines to reduce power consumption and increase energy savings. Though the bill that transposes the EC directive’s clauses into Dutch law has not yet passed the senate as of 28 February 2015, the Netherlands already complies with the directive’s general requirements.
