Commissioner of Taxation [2013] FCA 341 (15 April 2013) where it raises important questions for local vendors of packaged tours to foreign travel agents. The decision by the Federal Court of Australia has led to the exposure of entities selling the package to be liable for any non-delivery of the package (or part of it) to the end consumer by the third party who actually provides the service to the tourist (such as a hotelier). Vendors of package tours would be well advised to review the terms and conditions under which they sell packages to ascertain their exposure for non-performance by the end service provider such as a hotelier.
