Environmental Markets in Australia

Environmental issues know no boundaries. Whether you are a company operating in the utilities, resources, property development, manufacturing or waste management sectors, a government addressing climate change issues or a financial institution wanting to maximise opportunities in emerging environmental markets or minimise environmental risks in your investment portfolio, our Environmental Markets team has the experience you need.

We advise public and private sector organisations in diverse industries including energy, mining, financial services, waste, transport, manufacturing, development and retail. We also advise regional and national governments on the implementation of climate change law and policy, market-based industry reforms and have prepared empowering regulation and draft industry codes. Advising and representing clients in contentious matters is also part of our service offering when other avenues of action are exhausted. We regularly appear in Courts and Tribunals and have successfully represented clients in many unique cases.

Our team's capability is unique in the Asia Pacific region. It combines the core environment and planning experience required to advise on infrastructure, resources and other major projects as well as having extensive experience advising on emerging environmental markets. Our lawyers are among the world's leading advisors in global emissions trading strategies, climate change and renewable energy law and policy.

With the dust having now settled on last year's historic COP21 negotiations in Paris, the focus will be on domestic implementation of each Parties' Nationally Determined Contributions (NDCs). For Australia, implementation of its commitment to reduce its emissions will be, in part, through the Government's Direct Action Scheme. This consists of a USD2.55 billion Emissions Reduction Fund (ERF) and the Safeguard Mechanism to "ensure that emissions reductions purchased through the Emissions Reduction Fund are not displaced by a significant rise in emissions above business-as-usual levels elsewhere in the economy."
