Energy in Australia

Baker & McKenzie has one of Australia's largest dedicated energy and resources teams, with experience in all Australian jurisdictions. The depth of our energy practice allows us to advise on all facets of the energy industry including regulation, major project development and mergers and acquisitions. We have been trusted advisors to some of Australia's, and the globe's, leading power and petroleum companies. Through Baker & McKenzie's market-leading Clean Energy & Renewables Group we also advise our clients on carbon offsets and trades, as well as clean energy projects.

Our Group is closely involved with Baker& McKenzie's regional and global practice groups. The strength of this relationship allows us to bring global best practice to assist our clients in their Australian energy activities. This has been illustrated by our appointment in many of the major energy and resource transactions over the past decade.

Our practice sits within Baker & McKenzie's Corporate Group where our dedicated energy lawyers draw on the experience of experienced corporate, private equity, capital markets and environmental lawyers with significant energy clients. This broader experience ensures our clients receive high-quality legal advice.

On April 8, 2014, the German Federal government approved a legislative bill for a sweeping reform of the German Renewable Energy Sources Act (“EEG”). The bill will now be brought before the German parliament and is scheduled to enter into force on August 1, 2014. Our client alert discusses the key points of the proposed reform.
On 9 April 2014, the European Commission adopted the new Guidelines on state aid for environmental protection and energy 2014-2020 (“EEA Guidelines”).They replace the existing guidelines as of 1 July 2014. Particularly the EEA Guidelines' new detailed rules for the approval of operating aid for electricity generation from renewable sources will have significant implications for the renewable energy industry.
On 30 July 2014, the EU has adopted additional sanctions in response to the current situation in the Ukraine (the EU Sanctions). The measures include a number of prohibitions and restrictions for transactions in Russia, in the Crimea Region and with certain Russian counterparties. Companies in Germany need to be aware of these sanctions, because they can have far-reaching effects on any business with Russia and the Ukraine.
