Customs & Trade Measures in Australia

Baker & McKenzie has extensive experience advising clients on customs and trade law. We assist clients with a wide range of trade issues, including export controls and sanctions rules, customs rules, WTO rules, free trade agreements and trade remedies.

We work in conjunction with our colleagues throughout Europe, North America, Latin America and the Asia-Pacific to provide clients with practical solutions by combining technical excellence with a creative results-orientated approach.

We represent clients in anti-dumping inquiries and challenge decisions to impose anti-dumping and countervailing duties. We also advise clients on challenging decisions under the quarantine legislation, therapeutic goods legislation as well as in customs classifications and valuation decisions. The nature of these matters often requires us to assist clients in preparing and drafting detailed submissions during audits or trade measures investigations.

Our extensive global reach allows us to operate seamlessly across jurisdictions – offering our clients superior service in what is a truly international area of law.

The Law on Regulation of Retail Trade, passed on 29 January 2015, includes key points on a new government information system for licenses (PERBIS), compulsory areas within malls, labels, marketing, payment flows with suppliers, and areas for local government clearance. Retailers have from one to two years to comply.
The scope of disputes is becoming increasingly broad, in terms of the technical issues at hand, the number of stakeholders and also the public relations issues. Managing effectively all these difficult issues and stakeholders is the key to resolving a dispute successfully and efficiently. We will demonstrate how to do this by evaluating both the technical issues at hand, and also the tactical options available to taxpayers.
Regulations passed in January affect providers of utilities, online content and other consumer services by subscription. Among the new rules, effective 24 April, is one that allows consumers to terminate, without cause or penalty, subscriptions that are indefinite or with a term longer than one year.
